II.2.4) Description of the procurement:

Metroselskabet (‘MS’) is constructing Cityringen in Copenhagen. Cityringen comprises 16 km tunnels, 17 underground stations and 4 shafts. MS is also constructing a branch off to Sydhavnen (‘Sydhavnsmetroen’). Sydhavnsmetroen is a dual track branching off the Cityringen, starting after a bifurcation chamber at Havneholmen shaft near the control and maintenance center for Cityringen. Sydhavnsmetroen will be located below ground comprising 5 stations. The contract covered by this voluntary ex-ante transparency notice comprises Operation and Maintenance (‘O&M’) for Sydhavnsmetroen and covers trial run and an operation and maintenance period of one (1) year. The contract will be an addendum to the original contract on transportation system and O&M for Cityringen entered between MS and Hitachi Rail STS.

IV.1) Description
IV.1.1) Type of procedure
Negotiated procedure without prior call for competition
  • The works, supplies or services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons
Explanation:

O&M for Sydhavnsmetroen must be an integrated part of both the transportation system (‘TS’) and O&M for Cityringen. TS and O&M for Cityringen consist of a number of TS and O&M sub-systems. In order to obtain the necessary safety approvals of TS and O&M for Sydhavnsmetroen as part of Cityringen and to ensure safe, reliable and stable operations at satisfactory levels the technologies and systems which have already been chosen for Cityringen must also be applied on Sydhavnsmetroen. Furthermore, O&M for Sydhavnsmetroen must be completely integrated with O&M for Cityringen as the O&M supplier on Sydhavnsmetroen must make use of the same trains, systems, maintenance and control centres as used on Cityringen itself. Due to these technical reasons O&M for Sydhavnsmetroen can only be supplied by the excisting TS and O&M supplier on Cityringen, Hitachi Rail STS. The works covered by this voluntary ex-ante transparency notice may therefore only be executed by Hitachi Rail STS due to lack of competition for technical reasons, cf. the Utilities Directive (Directive 2014/25/EU), article 50 (c) (ii).
