Aftalen vil ikke blive indgået før udløbet af 10 kalenderdage regnet fra dagen efter den dag, hvor denne bekendtgørelse er offentliggjort, jf. klagenævnslovens § 4, stk. 1, nr. 2. I henhold til klagenævnslovens § 7, stk. 3, skal en klage over, at ordregiveren i strid med udbudsreglerne har indgået en aftale uden forudgående offentliggørelse af en udbudsbekendtgørelse i Den Europæiske Unions Tidende, i tilfælde hvor en ordregiver har fulgt proceduren i § 4, være indgivet til Klagenævnet for Udbud inden 30 kalenderdage regnet fra dagen efter den dag, hvor ordregiveren har offentliggjort en bekendtgørelse i Den Europæiske Unions Tidende om, at ordregiveren har indgået en aftale, forudsat at bekendtgørelsen indeholder begrundelsen for ordregiverens beslutning om at tildele aftalen uden forudgående offentliggørelse af en udbudsbekendtgørelse i Den Europæiske Unions Tidende. Other justification :  FMI har behov for at forlænge rammeaftalen 4600004908 vedr. service og vedligehold af forsvarets TMA radarsystemer med Indra Sistemas S.A. med 7 år. Rammeaftalen indeholder optioner på i alt 16 år, og FMI anvender ved denne forlængelse optioner på 7 år. Der resterer herefter optioner på 9 år i rammeaftalen. Det er FMI's vurdering, at denne forlængelse kan foretages med hjemmel i Forsvars- og sikkerhedsdirektivets artikel 28 litra e, idet det er FMI's vurdering, at Indra Sistemas S.A. er den eneste, der af tekniske grunde kan foretage vedligehold og service af radarsystemerne.
