Metroselskabet is constructing Cityringen and its extension to Nordhavn in Copenhagen. Cityringen is a 16 km long underground metro with 17 stations and the Nordhavn branch is 2,5 km with 2 stations, 1 underground and 1 above ground. The Nordhavn branch is connected with Cityringen. Both Cityringen and the Nordhavn branch are operated with the same driverless, unmanned passenger vehicles delivered by Ansaldo STS.
The Nordhavn branch of Cityringen is to be further extended which together with the need of providing more robustness to the Cityringen operation is causing a need to purchase 4 extra passenger vehicles. In order to obtain a solution that is technical compliant with the existing passenger vehicles and the overall Transportation System of Cityringen and the extension to Nordhavn the 4 new passenger vehicles must be purchased from the existing supplier, Ansaldo STS.

The Transportation System of the extension of Cityringen to Nordhavn is fully integrated with the Transportation System of Cityringen using the same technical solutions for all systems that interface to the train equipment for control and monitoring. These systems include the train control, propulsion, braking and communication as well as interfacing to subsidiary systems for proper monitoring of functionality. Consequently, the level of the interface reaches into almost all aspects of the vehicle operation and the design is especially tailored to the technology of the chosen passenger vehicles for Cityringen. In order to obtain a technical compliant solution that corresponds with the technical demands of the Transportation System regarding the control system, radio communication, ATC and passenger information etc. it is necessary to purchase the 4 new passenger vehicles for the Nordhavn extension from the supplier on Cityringen, Ansaldo STS. A purchase from a new supplier will not be compliant with the Transportation System or will at least cause Metroselskabet excessive expenses for an alternative and adjusted solution in consequence of the fact that Cityringen is a unique design with an unusual size and very specific functional and performance requirements. These requirements are not generic and therefore there is no ‘off the shelf’ alternative design that could be proposed. Integration of the vehicle with the infra-structure is a complex process with many interfaces that would have to be made identical or purchased from Ansaldo STS. In particular, the carbone controller for the train control would only be able to be provided by Ansaldo STS. This also applies to all other equipment that interfaces with the communication infrastructure. The time to develop a compatible alternative vehicle therefore will be around 3-4 years and the very short production run would not allow absorption of the design costs. Furthermore the operation and maintenance (O&M) costs for different vehicles would be very excessive and disproportionate compared with the O&M costs for the existing vehicles fleet. In addition, a purchase from the existing supplier is necessary in order to obtain the necessary safety approvals of the entire Transportation System for both Cityringen and the Nordhavn branch and those related to the passenger vehicles. In order to ensure safe, reliable and stable operation it is therefore necessary to use the same technology and vehicles which have al-ready been purchased for Cityringen and the Nordhavn branch. On that ground it is Metroselskabet's opinion that Metroselskabet is allowed to purchase the 4 extra passenger vehicles directly from the existing supplier, Ansaldo STS, without previous public notice according to article 40, stk. 3, litra e, in the Utilities directive (2004/17/EU).
