IV.1) Description

  • Additional deliveries by the original supplier ordered under the strict conditions stated in the directive
Explanation:

GE delivered the existing installation at the 132 kV substation Avedøreværket in 2019.

The technical drawings of the substation are the property of GE and can therefore not be handed over to another supplier. Consequently, supplies originating from other sup-pliers are assessed to result in incompatibility or disproportionate technical difficulties in operation and maintenance as another supplier would have to completely disconnect the system to make the necessary technical examinations and adjustments (if at all pos-sible). Further, when the substation was installed by GE, an extension, corresponding to the one now needed from GE, was included in the design. The technical environment constituting the 132 kV substation Avedøreværket has been constructed in correspondence with said design and any changes thereto would therefore compromise the re-quired clearance distance to other, already installed, critical equipment on the station.

As the substation Avedøreværket is critical for security of supply in Copenhagen, and as a consequence of the reasons stated above, the Contracting Authority has assessed that a legal basis for the award can be found in article 50 (e) of the directive 2014/25/EU.

Complaints regarding a candidate not being pre-qualified must be filed with The Complaints Board for Public Procurement within 20 calendar days starting the day after the contracting authority has sent notification to the candidates involved, provided that the notification includes a short account of the relevant reasons for the decision.

Energinet shall follow the procedure in Section 4 of the Act on the Board of Appeal (Consolidated Act No 593 of 2.6.2016 on the Public Procurement Board of Appeal, available at: www.retsinformation.dk).
